Titan Cleaning Co: Service Agreement Terms and Conditions

Welcome to Titan Cleaning Co. ABN: 67203631415 ("we," "us," or "our") Service Terms and Conditions. These Terms and Conditions ("Terms") govern the provision of exterior cleaning services ("Services") including, but not limited to, driveway and surface cleaning, roof cleaning, and exterior wall cleaning. By engaging our Services, you ("Client" or "you") agree to be bound by these Terms. Please read them carefully.

1. Scope of Services

Titan Cleaning Co. will provide the Services as outlined in the written service quote provided to you. The scope of work is limited to the specific areas and tasks agreed upon in writing. Any modifications or additional services requested after the initial agreement must be documented in writing (e.g., email or amended quote) and may incur additional fees, to be agreed upon by both parties. Verbal requests are not binding unless confirmed in writing.

2. Payment Terms

2.1 Payment

The cost of Services will be outlined in the service quote provided to you prior to the commencement of work. All prices are in AUD and exclude applicable taxes unless otherwise stated.

For service fees exceeding $175:

  • Full Payment Upfront: The entire service fee is due prior to the commencement of the Services.

  • Deposit and Balance: A 50% deposit is required prior to scheduling the Services, with the remaining 50% due upon completion of the work.

For service fees of $175 or less:

  • The Client may opt to pay the full service fee upon completion of the work.

The chosen payment option must be specified in the service quote or agreement. If no option is specified, the Full Payment Upfront option will apply by default for fees exceeding $175, and payment upon completion will apply for fees of $175 or less.

By agreeing to these terms, the Client accepts the attached quote provided with the service agreement and agrees to pay the listed price within 7 days of service completion. Failure to pay on time will incur interest at a rate of 3% per month on any outstanding balance, in exchange for our agreed-upon services.

If the Client disputes the quality of work, they must notify Titan Cleaning Co. in writing within 3 days of completion, detailing the issue. Payment for undisputed portions remains due on time.

2.2 Payment Methods

Payments may be made via cash, credit card (Visa, Mastercard), or bank transfer. Credit card payments incur a 3% processing fee. Late payments will incur a fee of 3% per month on the outstanding balance.

2.3 Non-Payment

Titan Cleaning Co. reserves the right to suspend or terminate Services and pursue legal remedies if payment is not received within 7 days of the due date.

3. Water Usage

For the convenience of both parties, Titan Cleaning Co. will use the Client’s local water supply to perform the Services, unless otherwise agreed in writing. The Client agrees to provide access to an operational outdoor water source (e.g., spigot or hose) and warrants that the water supply is safe, suitable for use, and complies with all local water usage laws and regulations. Titan Cleaning Co. is not responsible for water usage costs, water quality issues, violations of water regulations, or any damage resulting from the Client’s water supply (e.g., sediment, contaminants).

4. Result Expectations and Warranties

4.1 Service Expectations

Titan Cleaning Co. will perform the Services with reasonable care and skill, using industry-standard techniques and equipment. However, results may vary based on factors outside our control, including weather conditions, the age and condition of surfaces, pre-existing damage, or staining that cannot be reasonably removed. We do not guarantee the removal of all stains, discoloration, or debris, particularly on aged or porous surfaces. We to serve in good faith, however, we cannot be held responsible for pre-existing damage, or the client’s negligence/failure to uphold their responsibilities outlined in clause 5.0 Client responsibilities.

4.2 Limited Warranty

We warrant that the Services will be performed in good faith, and in a professional manner. A "defect in workmanship" is defined as a failure to meet industry standards due to our error. If you notify us in writing (e.g., email to info@titancleaning.com.au) within 7 days of service completion, providing evidence (e.g., photos) of the defect, we will, at our discretion, re-perform the affected portion of the Services at no additional cost, provided the issue is not due to Client negligence or external factors (e.g., weather, misuse). This warranty does not cover pre-existing damage, natural wear and tear, or issues arising after the service due to environmental conditions.

5. Client Responsibilities

To ensure a smooth and safe service experience, the Client agrees to:

  • Prepare the Area: Clear the work area of vehicles, furniture, decorations, and other obstacles prior to our arrival. We are not responsible for moving items or any resulting damage.

  • Pets and Safety: Secure pets and ensure children or unauthorized persons do not enter the work area during the Services.

  • Access: Provide unobstructed access to the property, including water sources, adequate parking, and space for Titan Cleaning Co.’s vehicles and equipment.

  • Payment: Pay all fees in accordance with Section 2.

  • Notification: Inform us of any known hazards (e.g., damaged surfaces, loose roofing) or special conditions prior to service commencement.

6. Cancellations and Refunds

  • Cancellations by Client: Cancellations made less than 48 hours before the scheduled service will forfeit the deposit. Cancellations made earlier will receive a full refund of any deposit paid.

  • Cancellations by Titan Cleaning Co.: We reserve the right to cancel or reschedule Services due to inclement weather (defined as heavy rain, storms, or extreme heat above 35°C/95°F), equipment failure, or other unforeseen circumstances. In such cases, we will provide at least 24 hours’ notice, and deposits will be refunded or applied to a rescheduled date at the Client’s discretion.

  • No Refunds for Completed Services: Refunds will not be issued for Services completed in accordance with these Terms, even if the Client is dissatisfied with the results, unless covered under the limited warranty in Section 4.2.

7. Liability and Damages

  • Limitation of Liability: Titan Cleaning Co.’s liability for any claim arising from the Services is limited to the amount paid by the Client for the Services. We are not liable for indirect, consequential, or incidental damages (e.g., lost profits, property value diminution).

  • Pre-Existing Conditions: Before work begins, the Client must disclose and, if requested, provide photos of any pre-existing damage. Titan Cleaning Co. may document the property’s condition upon arrival. We are not responsible for damage to surfaces or structures that were already compromised (e.g., cracked concrete, loose shingles) prior to service commencement.

  • Property Damage: While we take every precaution, exterior cleaning involves inherent risks (e.g., water pressure damage). Any damage caused by our negligence will be addressed under our limited warranty or insurance, at our discretion. The Client must inspect the work upon completion and report any issues to the service team before they leave, or claims may be limited.

8. Force Majeure

Titan Cleaning Co. is not liable for delays or failure to perform Services due to events beyond our reasonable control, including but not limited to severe weather, natural disasters, government restrictions, pandemics, public health emergencies, or equipment failure. In such cases, we will work with you to reschedule the Services.

9. Insurance

Titan Cleaning Co. maintains general liability insurance up to AUD 1,000,000 per occurrence to cover accidental damage caused by our negligence during the Services. Proof of insurance is available upon request. Clients are encouraged to maintain their own property insurance for pre-existing conditions or unrelated damages and to inform their insurer about the scheduled Services.

10. Dispute Resolution

Any disputes arising from these Terms or the Services will first be addressed through good-faith negotiation between the parties. If unresolved within 30 days, disputes will be submitted to local mediation in Hervey Bay QLD. If mediation fails, disputes will proceed to binding arbitration under the rules of the Australian Arbitration Association, held in Queensland Australia. The arbitrator’s decision is final. These Terms are governed by the laws of Queensland, Australia.

11. Termination

  • Either party may terminate this agreement with written notice if the other party breaches these Terms (e.g., non-payment, failure to provide access) and fails to remedy the breach within 5 days.

  • The Client may terminate this agreement if dissatisfied with the progress of the Services, provided they pay for Services completed up to that point, as assessed by Titan Cleaning Co.

  • Upon termination, the Client remains liable for payment for any Services already performed.

12. Miscellaneous

  • Entire Agreement: These Terms, along with the service quote, constitute the full agreement between the parties and supersede any prior discussions or agreements.

  • Amendments: Changes to these Terms must be made in writing and must be signed by both parties.

  • Severability: If any provision is found unenforceable, the remaining provisions will remain in effect.

  • Notices: All notices must be in writing via email to info@titancleaning.com.au or certified mail to: Parcel Locker 10213 15986, 414 Esplanade, TORQUAY QLD 4655.

  • Successors: These Terms bind the parties and their successors, heirs, and assigns.

13. Media Usage

Service Documentation
The Client acknowledges and agrees that Titan Cleaning Co. may capture photographs, videos, or other media ("Media") of the Services provided, including before-and-after comparisons, work-in-progress shots, and completed results. Media may be captured solely for documentation, marketing, training, and promotional purposes.

Privacy Considerations
Titan Cleaning Co. will take reasonable steps to avoid capturing identifiable personal information (e.g., license plates, people’s faces, home addresses) unless explicitly permitted by the Client. If the Client wishes to opt out of media usage, they must notify Titan Cleaning Co. in writing before the commencement of Services.

Use and Ownership
Titan Cleaning Co. retains the right to document its work and may use collected media for operational and promotional purposes. By engaging our services, the Client acknowledges that such media may be used across various platforms, including but not limited to marketing and training materials.

Discretionary Review
Requests for Media removal will be considered in good faith where reasonable.
